When in a U.S.-Greek divorce, there are a range of Greek laws that could prove quite impactful for a Greek American. If the divorce is filed in Greece, among these rules are the procedures for getting a divorce in Greece.
Recently, changes to procedural rules for one particular class of divorce in Greece have been proposed. Specifically, a proposal has been put out aimed at putting in new procedures for uncontested divorces in Greece. The proposed changes are aimed at simplifying the process for getting an uncontested divorce and reducing the amount of time the process takes. Among the things the new procedures would do are take having a trial out of the uncontested divorce process and reduce the number of proceedings the process would involve.
One wonders what will happen with these proposed changes. It will be interesting to see, if the proposed changes are eventually enacted, what impacts they will have on divorces in Greece.
Another class of Greek divorce laws that can play a very big role in U.S.-Greek divorces are the laws regarding the big issues in divorces, such as property division and child custody.
Now, whether a U.S.-Greek divorce is filed in the U.S. or Greece, some challenging questions can arise as to which country’s laws, America’s or Greece’s, apply to the various key legal issues in the divorce. Given the major impact what law applies to these issues can have, receiving good legal guidance on and clear explanations of what factors impact which country’s laws apply in a given situation can be very important for a Greek American when in a U.S.-Greece divorce.
